试论司法交易行为的市场化

内容提要：司法交易行为是指寄生在司法活动过程中的各种腐败行为或现象，依其在整个司法体系中 的演化过程，从理论上可划分为以下几个递进层次:司法交易行为――司法腐败――司法交易行为 市场化――司法活动市场化――司法的制度性腐败。本文从社会信息经济学的视角剖析司法交易行 为的性质及其一般运行机制，从中概括出司法交易行为市场化的基本构成体系和发展趋势，进而揭示司法腐败的规模化发展，不仅会促进司法资源的市场化配置和运作，还将导致司法活动的制度性腐败。
